OFFICIAL RULES
THE FOLLOWING CONTEST IS INTENDED FOR PLAY IN THE 50 UNITED STATES AND DISTRICT OF COLUMBIA ("D.C.") AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO U.S. LAW. DO NOT ENTER THIS CONTEST IF YOU OR THE PERSON YOU ARE NOMINATING ARE NOT A LEGAL RESIDENT OF AND LOCATED IN THE 50 UNITED STATES OR D.C. AT TIME OF ENTRY.
The Rebuilding Together’s Tradeperson of the Year Contest (the “Contest”) begins online at 12:01 a.m. EST on October 15, 2011 (the “Contest Start Date”) and ends at 11:59 p.m. EST on April 28, 2012 (the "Contest End Date") (such period referred to herein as the “Contest Period”). The Contest is sponsored by Rebuilding Together, Inc. (the “Contest Sponsor”).
1. HOW TO ENTER: NO PURCHASE NECESSARY TO ENTER OR CLAIM PRIZE. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
How to Submit a Nomination: In order to nominate one (1) person (male or female) as the 2011 "Rebuilding Together Tradesperson of the Year™" (i) obtain the nominee’s prior consent, and (ii) provide the information requested in all categories in the space(s) designated in the online nomination form available at the contest micro-site www.rttradespersonoftheyear.com (the “Contest Website”). The nomination must be for a tradesperson in one of the following six categories (the “Trade Categories”):
- Carpenter
- Contractor
- Electrician
- HVAC/Plumber
- Painter
- Roofer
Nominations must be received by 11:59 EST on January, 20, 2012. Be sure to include all information requested, including your organization name, your name, title and a valid phone number and e-mail address, as well as the name and a valid address, telephone number and e-mail address of the person you are nominating for the "Rebuilding Together Tradesperson of the Year™?." Self-nominations are prohibited. To nominate an individual you must have such nominee’s prior consent and be familiar with the nominee's work in the community or with Rebuilding Together. All nomination submissions must adhere to the 250 words or less requirement for the section explaining why the nominee should be the Rebuilding Together Tradesperson of the Year™. Any submission with more than 250 words in this section will be subject to disqualification. No mail-in, e-mail or fax entries will be accepted.
Participation in the Contest is voluntary and does not require you to purchase anything from the Contest Sponsor. No illegible, incomplete, forged or altered entries will be accepted. All nominations received become the property of the Contest Sponsor and will not be returned. Nominations are limited to one (1) per nominator. If one person is nominated by more than one nominator, Contest Sponsor reserves the right to select one nomination form for the basis of judging.
2. PRIZES:
Grand Prize: The Grand Prize winner will be announced at the National Building day press conference in Washington, D.C., or another location determined by Contest Sponsor, on April 28, 2012. One (1) Grand Prize will be awarded, consisting of:
A. Round-trip coach airline transportation for two (2) to Washington, D.C. (or another location determined by Contest Sponsor) from the major airport nearest winner's home, hotel accommodations (double occupancy) for two (2) days/one (1) night, rental car (eligible drivers only) and meal stipend for two, in connection with attending the National Building day press conference on April 28, 2012; and
B. Round-trip coach airline transportation for two (2) to New Orleans, LA from the major airport nearest winner's home, hotel accommodations (double occupancy) for five (5) days/four (4) nights, rental car (eligible drivers only), meal stipend for two, two (2) tickets to Super Bowl XLVII, $500 in spending cash, a collection of WD-40 products and Craftsman tools, and an invitation as a guest co-host during the live broadcast of “On the House” during Rebuilding Together’s annual Kickoff to Rebuild during Super Bowl weekend.
Winner and guest are responsible for other meals, taxes, gratuities and all other expenses not specified herein, including but not limited to, parking; telephone, fax or cable charges imposed while using any accommodations; personal services and expenses such as laundry, valet, room service; insurance; medical travel documents; and other incidental costs and any other costs not specifically stated herein as being included. Exact travel dates and arrangements subject to availability. Actual value of trip depends on point of departure and airfare fluctuations. Winners and guests must travel together on dates to be specified by Contest Sponsor, or prize will be forfeited in its entirety. If the National Building day press conference or the game are cancelled for any reason, or postponed beyond winner's stay in Washington, D.C. or New Orleans, LA, as applicable, no compensation will be awarded in lieu thereof but remainder of prize package may be awarded at Contest Sponsor's discretion. Approximate retail value of Grand Prize: $29,000 (U.S.).
Runner-Up Prizes: Five (5) Runner-Up Prizes will be awarded, each consisting of prizes donated by various sponsors. Approximate retail value: $1,000 (U.S.) per prize. Total Approximate retail value of all Runner-Up Prizes: $5,000 (U.S.).
Nomination Prizes: Those who nominated each of the six (6) Rebuilding Together Tradesperson of the Year™? finalists will be awarded prizes donated by various sponsors. Approximate retail value: $500 (U.S.) per prize. Total Approximate retail value of all Nomination Prizes: $3,000 (U.S.).
Odds of winning are affected by the number of eligible entries received by January 20, 2012. The total approximate retail value of all prizes is $37,000 (actual value may vary). Allow 3-4 weeks after validation of arrangement for receipt of prize. Only one (1) Grand Prize, five (5) Runner-Up Prizes and six (6) Nomination Prizes will be awarded. Prizes are non-transferable. No prize substitutions or cash equivalents will be made except at Contest Sponsor's sole discretion or as provided herein. Contest Sponsor reserves the right to offer a prize of equal or greater value should a featured prize or any portion thereof become unavailable. The Contest Sponsor is only responsible for prize delivery. In order to receive a prize, the winners may be required to provide proof of identification. Any and all taxes on any prize (if any), including income and/or sales taxes, are the sole responsibility of the winner. All prizes will be awarded to the persons named on the nominations, and NOT to the persons who submitted the nominations.
3. ELIGIBILITY: Nominators and nominees must be legal residents of the 50 United States, District of Columbia, and 21 years of age or older. Entries are limited to individuals only; commercial enterprises and business entities are not eligible. By participating in the Contest, each participant accepts the conditions stated in these Official Rules, agrees to be bound by the decisions of the Contest Sponsor and warrants that she/he is eligible to participate in the Contest. Employees, independent contractors, officers, and directors of the Contest Sponsor, affiliates, subsidiaries, distributors, retailers and advertising and promotion agencies and the immediate family and household members of each of the above are not eligible to participate in the Contest. THE CONTEST IS VOID OUTSIDE THE 50 UNITED STATES AND D.C., AND WHEREVER PROHIBITED OR RESTRICTED BY LAW and is subject to applicable federal, state, provincial, and local laws and regulations.
4. SELECTION OF WINNERS:
Initial Screening Process: All nominations received by January 20, 2012 will be judged by Contest Sponsor on the basis of the following criteria:
- Service to Community (33%)
- Contribution to success of local nonprofit
- Leadership role provided to nonprofit
- Contribution to industry or trade (33%)
- Industry skills and expertise
- Leadership role in industry or trade
- Service to industry or trade
- Living the values of Rebuilding Together and the Presenting Sponsor WD-40 Brand (34%)
- Honesty
- Integrity
- Generosity
- Versatility/Flexibility
- Problems Solving Skills
- Getting the job done
On or about January 21, 2012, Contest Sponsor will select three (3) candidates from each of the Trade Categories.
Judge Selection: The Judging Panel will be comprised of members from the following companies: WD-40 Company, Sears/Craftsman Tools, GAF Materials, Rebuilding Together, Nuffer Smith & Tucker, and HGTV/DIY Network. On or about January 23, 2012 the Judging Panel will use the same criteria as used in the Initial Screening Process to select one finalist in each of the Trade Categories for a total of six (6) finalists (each a “Finalist” and collectively, the “Finalists”). The Judging Panel will only compare the three (3) candidates in a particular Trade Category to determine the Finalist for that particular Trade Category (Finalists are not compared with Finalists in other Trade Categories at this point in the selection process). Finalists will be notified by phone by Contest Sponsor on or about February 1, 2012. Finalists will be interviewed live by the Carey Brothers during “On the House.”
Public Voting: On or about February 9, 2012 (the “Public Voting Start Date”), the six (6) Finalists will be displayed on the Contest Website. Individuals may vote once every twenty-four (24) hours at the Contest Website from the Public Voting Start Date through March 31, 2012 (the “Public Voting End Date”) (such period referred to herein as the “Public Voting Period”).
Final Selection Process: After the Public Voting Period, the Judging Panel will select the Grand Prize winner from amongst the six (6) Finalists using the following criteria: (A) Service to Community (25%), (B) Contribution to industry or trade (25%), (C) Living the values of Rebuilding Together and the WD-40 brand (25%) and (D) Public vote (25%). The decisions of the Judging Panel in the Final Selection Process will be final in all matters relating to this Contest.
All winners will be notified by phone and/or email and postal mail by or about April 14, 2012. Such notification shall include instructions for proper acceptance of the prizes by the winners. The Grand Prize winner will be invited to be Rebuilding Together’s guest at the National Building day press conference in Washington, D.C., or another location as determined by the Contest Sponsor, on April 28, 2012. In the event a winner does not accept a prize, a winner is ineligible, or the prize or prize notification is not deliverable, an alternate winner may be selected. The Contest Sponsor is not responsible for and shall not be liable for late, lost, misdirected or unsuccessful efforts to notify a winner. Winners will be required to sign and return an affidavit of eligibility and liability/publicity release (where permitted) within five (5) days of notification or prize may be forfeited and awarded to an alternate winner (time permitting) on the basis of the criteria set forth herein. Except where prohibited, acceptance of a prize constitutes winner's consent to use winner's name, likeness and biographical data for advertising and promotional purposes worldwide without limitation and without additional compensation.
5. CONDITIONS: Contest Sponsor, WD-40, Sears/Craftsman Tools, GAF Materials, Nuffer Smith & Tucker, HGTV/DIY Network, the Carey Brothers and Service Magic, and their respective agents, directors, officers, shareholders, employees, insurers, servants, parents, subsidiaries, divisions, affiliates, predecessors, successors, representatives, advertising, promotion, and fulfillment agencies, and legal advisors (the “Released Entities”), are not responsible for, shall not be liable for, and hereby disclaim all liability arising from or relating to: (i) lost, late, misdirected, incomplete, garbled, or unintelligible nominations, or for theft, destruction or unauthorized access to, or alteration of, nominations; (ii) any incorrect or inaccurate information, whether caused by website users or any of the equipment or programming associated with or utilized in the Contest, or for any technical or human error which may occur in the transmission or processing of submissions in the Contest; (iii) any error, omission, interruption, deletion, defect, delay in operation or transmission, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, email, players or browsers, whether due to technical problems, traffic congestion on the Internet or at any website, or to any combination of the foregoing; and (iv) any injury or damage to participants or to any computer related to or resulting from participating or downloading materials in this Contest. By participating in this Contest, participants agree to release, discharge and hold harmless the Released Entities, and all others associated with the development and execution of the Contest, from any and all losses, damages, rights, claims and actions of any kind arising out of or relating to the Contest, participation in the Contest, any prize, or any portion thereof that may have been awarded, and/or acceptance, possession, use or misuse of any prize, or any portion thereof that may have been awarded, including but not limited to statutory and common law claims for misappropriation or participant's right of publicity. If, for any reason, the Contest is not capable of running as planned, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Contest Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Contest Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the Contest and select the winners from among all eligible entries received prior to the time such action was taken. This Contest shall be governed by Delaware law. By participating in this Contest, participants agree that Delaware courts shall have jurisdiction over any dispute or litigation arising from or relating to this Contest and that venue shall be only in Wilmington, Delaware.
6. SUBMISSIONS: By submitting a nomination, you grant to Contest Sponsor and its designees a worldwide, non-exclusive, sublicenseable, assignable, royalty-free, perpetual, irrevocable right (including moral rights) and license to use, reproduce, distribute, create derivative works based on, perform and/or display such nomination, and any photographs, comments, ideas or other information provided (in whole or in part) in any media now known or hereafter developed, for any purpose whatsoever, without compensation to you or any other provider of the nomination. In addition, you acknowledge that to the extent that you include personally identifiable information in your nomination, Contest Sponsor may republish such information.
7. WINNERS LIST: To obtain the name of the Contest winner(s) after the Contest End Date, send a separate self-addressed, stamped envelope marked “Rebuilding Together’s Tradesperson of the Year™ Contest Winners List” to the Contest Sponsor. Requests for winners list must be received no later than 90 days from the Contest End Date (residents of Vermont and Washington need not include return postage).

9. NOTICE: ANY ATTEMPT BY A NOMINATOR, NOMINEE OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, CONTEST SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
